CloudBix Pty Ltd Services Terms and Conditions
Effective Date: 1 May 2023
These terms and conditions (“Terms”) apply to the following products and services provided by CloudBix Pty Ltd (“CloudBix”):
VoIP Services, including PBX Rental, VoIP Line (SIP), and Minutes
Data Solutions, including VoIP-Data, Fibre to the Home, Fibre to Business (on a month-to-month basis after 1 year), and LTE services
1. Contractual Terms
1.1. By accepting a quote or making the first payment (invoice) for any of the above services, the client agrees to these Terms.
1.2. Clients are not permitted to cancel their services within the first six (6) months of activation, except for Fibre products.
1.3. After the initial six-month period, a full calendar month’s (30 days) notice is required for the cancellation of any service.
1.4. Upon providing notice of cancellation, clients are responsible for two additional invoices during the notice period.
2. Cancellation and Notice
2.1. To cancel any service, clients must provide a written notice to CloudBix at least thirty (30) calendar days in advance.
2.2. This notice period begins on the day CloudBix receives the written notice from the client.
2.3. During the notice period, clients will be billed for two additional months of service, and these invoices must be paid in full.
3. Compliance with the Consumer Protection Act
3.1. These Terms comply with the Consumer Protection Act (CPA) of South Africa.
3.2. Clients are entitled to a cooling-off period of five (5) business days after accepting a quote or making the first payment. During this period, clients may cancel the service without penalty.
3.3. CloudBix will adhere to all provisions of the CPA, ensuring that these Terms do not infringe upon the rights of the consumer.
4. Amendments
4.1. CloudBix reserves the right to amend these Terms at any time. Clients will be notified of any changes at least thirty (30) days before such changes take effect.
4.2. Continued use of CloudBix services after the effective date of any amendments constitutes acceptance of the new Terms.
5. Governing Law
5.1. These Terms shall be governed by and construed in accordance with the laws of South Africa.
5.2. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
By using CloudBix services, clients acknowledge that they have read, understood, and agreed to these Terms.
